THIS MEMORANDUM INVESTIGATES THE ADMISSIBILITY IN EVIDENCE OF MICROFILM COPIES AS EITHER PRIMARY OR SECONDARY EVIDENCE AND THE AUTHORITY TO RETAIN RECORDS IN THE FORM OF MICROFILM COPIES.
Abstract
THE TENDENCY IN AMERICAN LAW TO ACCEPT THE ACCURACY OF PHOTOGRAPHICALLY REPRODUCED WRITINGS IS EXAMINED THROUGH A REVIEW OF RELATED CASE LAW AND STATUTES. THE LIMITATIONS OF THE BEST EVIDENCE RULE ARE CONSIDERED AS ARE EXCEPTIONS TO THE HEARSAY RULE. STATUTES CONCERNED WITH THE MAINTENANCE OF RECORDS ARE ALSO DISCUSSED. THE APPENDIXES SUMMARIZE STATUTORY SCHEMES IN ALL OF THE STATES AS WELL AS A COMPILATION OF SUMMARIES OF STATUTES OF THE STATES, PUERTO RICO, AND THE SEVERAL STATES WHICH DEAL WITH COPIES OF DOCUMENTS, MICROFILM COPIES, AND OTHER PHOTOGRAPHICALLY REPRODUCED COPIES.
