The author contends that, in certain circumstances, the due process clause supplies a mandate for the admission of eyewitness expert testimony at trial.
Abstract
First he examines the operation of the rules of evidence and explains the role the Constitution could play in decisions on eyewitness expert admissibility. He then argues that the Court's recent erosion of the exclusionary rule places a heavy due process burden on many trials where eyewitness identification is an issue. The article demonstrated how the admission of eyewitness expert testimony enables trials to meet this due process burden. 66 notes. (Author abstract)
