THIS IS A NARROWLY FOCUSED EXAMINATION OF THE POST-JUDGEMENT HISTORY OF THE RECENT, SIGNIFICANT CORRECTIONAL LAW CASE OF HOLT V. SARVER, DECIDED BY THE U.S. DISTRICT COURT FOR EASTERN ARKANSAS IN 1970.
Abstract
IT IS NOT AN EXAMINATION OF THE DEVELOPMENT OF CORRECTIONAL LAW OR MODERN CORRECTIONS IN GENERAL, BUT AN ANALYSIS OF HOW THIS CIVIL RIGHTS ACTION BROUGHT BY THE INMATES OF THE ARKANSAS STATE PRISON SYSTEM AFFECTED THAT SYSTEM, PARTICULARLY THE CUMMINS PRISON. THE STUDY DETAILS THE PROCESS BY WHICH HOLT V. SARVER, WHICH CHALLENGED VIRTUALLY EVERY ASPECT OF THE ENTIRE PENITENTIARY SYSTEM, WAS IMPLEMENTED AND THE FACTORS WHICH INFLUENCED THAT PROCESS. ALSO COVERED ARE THE ROLES OF THE VARIOUS PERSONS AND INSTITUTIONS INVOLVED, THE EXTENT TO WHICH COMPLIANCE WAS ACHIEVED, AND THE OVERALL OUTCOME OF THE LITIGATION. A DESCRIPTION OF THE BACKGROUND AND METHODOLOGY OF THE STUDY IS APPENDED. STUDIES OF THREE OTHER CASES ARE AVAILABLE AS NCJ# 40776, 40777, AND 40779. IN NCJ# 40775, BROAD FINDINGS FROM THE INDIVIDUAL STUDIES ARE PRESENTED IN AN INTEGRATED FASHION.
