OVERVIEW OF NATIONAL LEGISLATION AND INTERNATIONAL AGREEMENTS WORLDWIDE ON THE PREVENTION AND REPRESSION OF AIRCRAFT HIJACKING FOCUSING ON THE DIFFERENT DEFINITIONS AND CLASSIFICATIONS OF THE OFFENSE.
Abstract
IT IS SUGGESTED THAT EXISTING CONDITIONS BELIE THE FACT THAT PREVENTION SHOULD BE GIVEN THE HIGHEST PRIORITY. CITED ARE THE FAILURE TO INCLUDE HIJACKING ATTEMPTS WHILE ON THE GROUND IN THE MONTREAL AND HAGUE CONVENTIONS, LAX SECURITY SCREENING PROCEDURES IN CERTAIN INTERNATIONAL AIRPORTS, THE RELATIVELY LIGHT SENTENCES GIVEN HIJACKERS. ALSO POINTED OUT IS THE FACT, FOR LACK OF AN EXTRADITION TREATY, NUMEROUS HIJACKERS ESCAPE ALL PUNISHMENT. AN OUTLINE OF THE PROVISIONS OF BELGIUM'S ANTI-HIJACKING LAWS REVEALS THAT ANY ATTEMPT AT HIJACKING EITHER A GOVERNMENT OR PRIVATE AIRCRAFT OR AT ENDANGERING ITS PASSENGERS OR CREW IS PUNISHABLE BY UP TO LIFE IMPRISONMENT AT HARD LABOR IN THE CASE OF PERSONAL INJURIES OR PROPERTY DAMAGE. --IN FRENCH...ELW
