This special issue focuses on alternative dispute resolution (ADR) and the ways in which it can aid the practicing lawyer.
Abstract
Following an overview of ADR in Texas and innovations in its practice, the role of judges and lawyers in a soon-to-be-initiated moderated settlement conference system is discussed. A description is provided of the training, caseloads, referral networks, and procedures used by Houston's Dispute Resolution Centers. Also described is the use of mediation, summary jury trial, the minitrial, and the structured settlement conference in resolving corporate disputes. The application of the moderated settlement conference to civil cases is described as well. Two articles examine the use of mediation in arriving at juvenile restitution agreements and in divorce settlement. A listing of ADR Centers in Texas and ADR resources in Houston provides contact information and brief descriptions of services and client populations. A glossary of ADR terms also is supplied.
