Alternative dispute resolution (ADR) refers to experimental procedures, such as mediation, arbitration, conciliation, and summary jury trials, that differ from traditional forms of adversarial litigation and prosecution.
Abstract
Describing the emerging national picture, as well as local variations, this pamphlet discusses the relationship between ADR and the courts, ADR techniques, cases in which ADR may be applicable, and the ABA Multi-Door Courthouse Dispute Resolution Centers Project. In summary, the benefits of ADR accrue to the litigants who experience greater client satisfaction, the lawyers who have new techniques with which to represent their clients, and the courts who gain an additional management tool. A bibliography is provided.
