Annotation
The rising number of grievances filed in the federal courts under the provisions of 42 U.S.C. 1983 has been a concern to judges, state attorneys general and correctional administrators. Although certain of these cases have resulted in changes in the conditions of confinement in a number of state correctional systems, a greater problem exists with regard to the vast portion of these cases that may be viewed as administrative or 'mini-grievances.'
Abstract
However, these problems can be dealt with through a strategy of preventive law and the use of alternative dispute resolution mechanisms. Six models of these mechanisms are described from data collected through a national study and observations of eleven correctional systems. Conclusions are given as to the relative success of these approaches. (Publisher abstract)
