This documents presents PROTECT Act amendments and other amendments submitted to Congress on May 1, 2003.
Abstract
Some amendments to the PROTECT Act include trafficking in material involving the sexual exploitation of a minor; possession of materials depicting a minor engaged in sexually explicit conduct; acceptance of responsibility; and repeat and dangerous sex offender against minors. Also included are family ties and responsibilities and community ties; grounds for departure and diminished capacity; and aberrant behavior and specific offender characteristics as grounds for downward departure in child crimes and sexual offenses. Kidnapping amendments made pursuant to the PROTECT Act involve kidnapping, abduction, and unlawful restraint. These amendments to sentencing guidelines are effective April 30 and May 30, 2003. The following amendments were submitted to Congress on May 1, 2003: involuntary manslaughter, corporate fraud, cybersecurity, terrorism, campaign finance, oxycodone, immigration, offenses involving body armor, and Section 5G1.3. There were also miscellaneous amendments including criminal sexual abuse; larceny, embezzlement, and other forms of theft; conflict of interest; unlawfully distributing a listed chemical; and obstructing an election or registration.
