BRIEF DISCUSSION OF THE DEVELOPMENT OF PENAL PHILOSOPHY WITH RESPECT TO PUNISHMENT, INCAPACITATION, DETERRENCE AND REHABILITATION, WITH EMPHASIS ON THE RECENT TURN FROM THE REHABILITATION MODEL.
Abstract
THE CONTENTION THAT REHABILITATION IS EFFECTIVE AND THAT COMMUNITY BASED FACILITIES HAVE NOT BEEN GIVEN A FAIR CHANCE ARE EXAMINED AND REJECTED. THE ARTICLE COVERS THE HIGHLY INACCURATE NATURE OF PAROLE PREDICTION AS WELL AS THE VARIOUS PROPOSALS TO ADOPT DETERMINATE PRISON SENTENCES AND TO ABOLISH PAROLE. THE AUTHOR CONCLUDES THAT THE PENAL SYSTEM SHOULD BE PREDICATED ON CERTAINTY, RATHER THAN SEVERITY, OF PUNISHMENT.
