PRETRIAL INTERVENTION, POSTTRIAL ALTERNATIVES TO INCARCERATION, PAROLE AND PROBATION, AND THE JUVENILE OFFENDER ARE AREAS EXAMINED AS FOCAL POINTS OF THE SOLUTION TO THE INCREASING PRISON POPULATION.
Abstract
AN OVERVIEW AND HISTORY OF PRETRIAL INTERVENTION ARE UNDERTAKEN, AND A SURVEY OF PRETRIAL INTERVENTION PROGRAMS AND THE CONSTITUTIONAL AND LEGAL ISSUES OF INTERVENTION ARE CONSIDERED. RECOMMENDATIONS FOR PROGRAM REFORM ARE OFFERED. ASPECTS OF THE GOALS AND PROCEDURES OF SENTENCING ARE ANALYZED AND GUIDELINES FOR SENTENCING ARE PRESENTED, FOLLOWED BY AN EXAMINATION OF WORK RELEASE AND RESTITUTION AS POSTTRIAL ALTERNATIVES TO INCARCERATION. THE HISTORIES OF PROBATION AND PAROLE ARE TRACED, AND THE NEED FOR REFORM OF PROBATION AND PAROLE POLICIES AND PROCEDURES IS DOCUMENTED. TERMS AND CONDITIONS OF PROBATION AND PAROLE AND THE CHARACTER OF SUPERVISION IN THE COMMUNITY ARE EXAMINED AND RECOMMENDATIONS ARE PROVIDED. THE STUDY CONCLUDES WITH AN OVERVIEW AND ANALYSIS OF THE STATE'S JUVENILE JUSTICE SYSTEM; JURISDICTION, PROBATION, AND AFTERCARE ARE EXAMINED. APPENDIXES FOLLOW EACH SECTION AND CONTAIN INFORMATION AND STATISTICS RELEVANT TO THAT SECTION. (RCB)
