The U.S. Sentencing Commission has analyzed certain provisions of the Violent Crime Control and Law Enforcement Act of 1993, H.R. 3355, in relation to sentencing goals articulated by the Sentencing Reform Act of 1984 and Federal sentencing guidelines.
Abstract
The analysis focuses on three-time loser provisions, specifically life imprisonment without release for drug felons and violent criminals who are convicted a third time and mandatory life imprisonment of persons convicted of a third violent felony. The analysis also examines provisions that restrict the manufacture, transfer, and possession of certain automatic assault weapons; mandatory minimum prison sentences for those who sell illegal drugs to minors or who use minors in drug trafficking; and flexibility in the application of mandatory minimum sentences. Each section of H.R. 3355 included in the analysis is briefly described, and information on related statutory law, sentencing guidelines, and prison impact is included. 63 footnotes, 10 tables, and 3 figures
