A HANDBOOK EXPLAINING VARIOUS ASPECTS OF JURY SERVICE, WRITTEN IN BOTH ENGLISH AND SPANISH IS PRESENTED; BENEFITS OF JURY SERVICE, JUROR QUALIFICATIONS, AND EVIDENCE CONSIDERATIONS ARE DISCUSSED.
Abstract
THE DUTIES AND RESPONSIBILITIES OF THE JUROR ARE EMPHASIZED THROUGHOUT THE WORK. TOPICS INCLUDE THE JUSTIFICATION FOR TRIAL BY JURY, CIVIL AND CRIMINAL CASES, JUROR SELECTION, TRIAL PROCEDURES, JUROR DEMEANOR DURING THE TRIAL AND JUROR BEHAVIOR IN THE JURY ROOM. ADDITIONAL SUBJECTS ADDRESSED INCLUDE JUROR CONDUCT OUTSIDE THE COURTROOM, OBJECTIONS TO EVIDENCE, JUDGING A WITNESS, THE VERDICT IN CIVIL CASES, THE FUNCTIONS OF JUDGE AND JURY, RULES OF LAW GOVERNING TRIALS, AND DEFINITIONS OF WORDS AND PHRASES. DURING THE TRIAL, JURORS SHOULD LISTEN TO EACH QUESTION AND ANSWER AND CONTROL THEIR EMOTIONS. JURORS SHOULD NOT TALK ABOUT THE CASE IN THE COURTROOM AND SHOULD NOT MAKE INDEPENDENT INVESTIGATIONS OF ANY ASPECT OF THE TRIAL. IT IS THE JURY'S FUNCTION TO DETERMINE WHAT PART OF THE EVIDENCE TO BELIEVE, HOW MUCH WEIGHT TO ATTACH TO ANY PART OF THE EVIDENCE, AND WHAT FACTS THE EVIDENCE ESTABLISHES. (LWM)
