This report presents an annual review on the use of electronic surveillance and presented to Parliament as required under section 195 of the Criminal Code for fiscal year 2004.
Abstract
Part VI of the Criminal Code of Canada sets out procedures for the law enforcement community to obtain judicial authorizations to conduct electronic surveillance of private communications to assist in criminal investigations. Section 195 of the Criminal Code requires the Minister of Public Safety and Emergency Preparedness to present to Parliament an annual report on the use of electronic surveillance. The report for 2004 provides an overview of the procedures and processes set out in Part VI, presents the statistical information that must be included in each report, and provides a general assessment of the importance of electronic surveillance for the investigation, detection, prevention, and prosecution of offenses. Statistics are presented in the areas of applications for authorizations and renewals, period for which authorizations and renewals were granted, offenses specified in authorizations, classes of places and methods of interception, legal proceedings, use of intercepted material and disposition, notifications, and prosecutions for unlawful interceptions and unlawful disclosure. The report is presented in both English and Spanish. Tables, figures, appendices A-B
