GENERAL PRINCIPLES COVERING APPELLATE REVIEW OF SENTENCES AND PROCEDURES COVERING SUCH REVIEWS ARE THE SUBJECT OF THESE DRAFT STANDARDS. THE REVISIONS REFLECT COURT DECISIONS SINCE THE ORIGINAL STANDARDS.
Abstract
THE PROCEDURE STANDARDS COVER THE AVAILABILITY OF REVIEW, SERVICE OF A PRISON TERM PENDING REVIEW, ITEMS WHICH SHOULD BE AVAILABLE FOR INCLUSION IN THE RECORD OF APPEAL, DUTIES OF THE REVIEWING COURT, POWERS OF THE REVIEWING COURT, SCOPE OF THE REVIEW, AND AVAILABLE DISPOSITIONS. ONLY MINOR CHANGES HAVE BEEN MADE IN THESE STANDARDS SINCE THE ISSUANCE OF THE FIRST EDITION OF THE AMERICAN BAR ASSOCIATION'S 'STANDARDS RELATING TO THE ADMINISTRATION OF CRIMINAL JUSTICE' PUBLISHED BETWEEN 1968-1973. EACH STANDARD IS FOLLOWED BY AN EXPLANATION OF CHANGES MADE SINCE THE FIRST EDITION, A LISTING OF RELATED STANDARDS, AND A COMMENTARY. FOOTNOTES CITE RELEVANT STUDIES, CONGRESSIONAL HEARINGS, AND COURT CASES. (GLR)
