THIS ARTICLE ARGUES FOR EXTENTION OF DUE PROCESS SAFEGUARDS TO PAROLE RELEASE HEARINGS IN LIGHT OF RECENT SUPREME COURT DUE PROCESS RULINGS FOR PROBATION OR PAROLE REVOCATION HEARINGS OR PRISON DISCIPLINARY HEARINGS.
Abstract
AN OVERVIEW OF THE PAROLE CONCEPT IS PRESENTED AND PAROLE RELEASE HEARINGS ARE EXAMINED. COURT DECISIONS ESTABLISHING THE PAROLEE'S RIGHTS WITH REGARD TO REASONS FOR DENIAL, RELEASE CRITERIA, AND DISCLOSURE OF FILES ARE REVIEWED. NEW YORK'S FREEDOM OF INFORMATION LAW IS ANALYZED TO ILLUSTRATE HOW STATES WITH SIMILAR LAWS CAN EXTEND DUE PROCESS SAFEGUARDS TO PAROLE RELEASE HEARINGS BY STATUTE.
