A REVIEW OF THE THEORETICAL BASES AND IMPLICATIONS OF THE PROVISIONS OF CANADA'S 1971 BAIL REFORM ACT.
Abstract
THE HISTORY OF THE ACT, AND THE OUIMET REPORT WHICH PROMPTED THE ACT, IS SUMMARIZED. GENERAL AREAS OF CONSIDERATION IN THE PROVISIONS OF THE ACT INCLUDE ARREST; APPEARANCE BEFORE THE JUSTICE; INFORMATION SUMMONS, AND WARRANTS; JUDICIAL INTERIM RELEASE; AND REVIEW OF DETENTION WHERE TRIAL IS DELAYED. OTHER TOPICS INCLUDE PRELIMINARY INQUIRIES, RELEASE PENDING APPEAL IN INDICTABLE MATTERS, SUMMARY CONVICTION APPEALS, DETERMINATION OF SENTENCE, AND HABEAS CORPUS PROCEDURES. PERCEIVED DEFICIENCIES IN THE ACT ARE NOTED, AND RECOMMENDATIONS ARE MADE FOR IMPROVEMENTS. SUGGESTED FORMS TO BE USED IN THE NEW PROCEDURES ARE REPRODUCED IN APPENDIXES.
