PURSUANT TO THE ORDER OF JANUARY 9, 1960, A SEPARATE RECORD OF ALCOHOL-RELATED OFFENSES IS MANTAINED WITHIN THE RECORDS OF EACH COURT OF GENERAL JURISDICTION AND OF THE PROSECUTING ATTORNEY'S OFFICE.
Abstract
PERSONS PICKED UP FOR PUBLIC DRUNKENNESS, EITHER BY THE POLICE, THE FIRE DEPARTMENT EMERGENCY SERVICES, OR AN ORDINARY CITIZEN, ARE TAKEN TO A HOSPITAL DETOXIFICATION TANK, GIVEN A MEDICAL EXAMINATION, AND EITHER HOSPITALIZED OR MERELY ALLOWED TO SOBER UP, DEPENDING ON THEIR PHYSICAL CONDITION. INDIVIDUALS BROUGHT IN BY THE POLICE WHO ARE NOT HOSPITALIZED ARE DETAINED BY THE POLICE, CHARGED WITH THE PERTINENT OFFENSE, AND SUBJECTED TO A FINE, IN THE CASE OF A FIRST OFFENSE, A FINE AND A SHORT JAIL SENTENCE, IN THE CASE OF A SECOND OFFENSE, AND A PRISON SENTENCE IN THE CASE OF MORE THAN TWO PRIOR OFFENSES. SINCE A RECORD IS KEPT OF EVERY PERSON CONVICTED OF AN ALCOHOL-RELATED OFFENSE, SENTENCING IS MADE EASY AND RECIDIVISTS ARE EASILY SPOTTED. RECORDS ARE DESTROYED ONE YEAR AFTER THE CAST RECORDED OFFENSE UPON THE DEATH OF THE INDIVIDUAL CHARGED, OR IN THE CASE OF AMNESTY. ANALYSIS OF THE RECORDS OF ALCOHOL-RELATED OFFENSES IN LYON (FRANCE) REVEALED THAT EIGHT PERCENT OF THOSE CONVICTED FOR PUBLIC DRUNKENNESS WERE RECIDIVISTS. --IN FRENCH...ELW
