The work of subjects in detention poses different problems during preventive custody and semifreedom.
Abstract
Despite the introduction of substantive reforms since the publication of the 1931 Prison Regulations, precise guidelines on prisoners' rights concerning work during these stages of detention are still lacking. The case of a laborer who is placed in preventive detention and ultimately released illustrates the problems faced by the worker as well as his employer. Sometimes the worker can have his right to job reinstatement acknowledged only by taking legal action. A new ordinance recognizes the right of subjects in a state of semifreedom to participate in work outside the place of detention as well as in other activities that promote social rehabilitation. Court interpretations of statutes separating work and detention emphasize the dependence of work approval on its ultimate value for the subject's successful mainstreaming into society.
