This revised Asset Forfeiture Policy Manual sets forth the policies of the U.S. Department of Justice for the Federal law enforcement community.
Abstract
Replacing and superseding all previous versions of the Asset Forfeiture Policy Manual and all policy directives and legal advice memoranda issued prior to December 2006, this manual sets forth the policies of the U.S. Department of Justice. The manual is divided into 12 chapters: (1) seizure and/or restraint; (2) administrative and judicial forfeiture; (3) settlements; (4) third party interests; (5) use and disposition of seized and forfeited property; (6) equitable sharing; (7) assets forfeiture fund; (8) attorney’s fees; (9) grand jury; (10) international forfeiture; (11) appointment of trustees and monitors; and (12) litigation issues. Chapters 1 and 2 have been substantially revised to conform to new Supplemental Rule G. In addition to the Rule G changes, Chapter 2 contains a new section on firearms forfeiture policy. In addition, Chapters 10, 11, and 12 are entirely new chapters covering international forfeiture, trustees and monitors, and litigation. Several new appendices have been added to the Manual. Some topics that require extended treatment are not addressed because they are addressed at length in stand-alone publications in the areas of criminal forfeiture money judgments, interlocutory sales and expedited settlements, financial investigations, and equitable sharing.
