THIS PAPER EXAMINES A VARIETY OF DEVELOPMENTS AND STUDIES THAT HAVE APPEARED IN THE U.S. AND ELSEWHERE IN RESPONSE TO THE PRESENT MONEY BAIL SYTEM.
Abstract
THE EARLY U.S. EXPERIENCE IN BAIL REFORM, SUCH AS THE MANHATTAN BAIL PROJECT, VARIOUS RELEASE ON RECOGNIZANCE (ROR) PROGRAMS, AND THE BAIL REFORM ACT OF 1966 ARE DISCUSSED AND EVALUATED IN TERMS OF ECONOMIC SAVINGS AND FAILURE TO APPEAR RATES. THE PREVENTIVE DETENTION PROVISIONS OF THE DISTRICT OF COLUMBIA COURT REFORM AND CRIMINAL PROCEDURE ACT OF 1970 ARE CRITICALLY ANALYZED. THE EXPERIENCES AND PRACTICES OF AUSTRALIA, CANADA, NEW GUINEA AND OREGON ARE REVIEWED. A BIBLIOGRAPHY OF BAIL AND PRETRIAL RELEASE SOURCES IS INCLUDED....MSP
