SEPARATE EXAMINATION OF PRE-TRIAL RELEASE SYSTEMS IN THE UNITED STATES AND IN ENGLAND.
Abstract
THESE SYSTEMS DIFFER IN MANY RESPECTS BUT THEY SHARE TWO CHARACTERISTICS. EACH DETAINS MANY ACCUSED PERSONS PRIOR TO TRIAL AND EACH IS UNDERGOING REEXAMINATION. LEGAL AND CONSTITUTIONAL QUESTIONS ON PRETRIAL RELEASE PROJECTS, OPERATIONAL TECHNIQUES USED, AND PROGRAMS FOR POLICE RELEASE OF ACCUSED PERSONS PRIOR TO INITIAL COURT APPEARANCE ARE DISCUSSED. ATTENTION IS FOCUSED ON THE ENGLISH PRACTICE OF PREVENTIVE DETENTION AND NONFINANCIAL SURETY, AND THE SHORTCOMINGS OF THE SYSTEM. BAIL REFORM MOVEMENTS, INCLUDING THE MANHATTAN BAIL PROJECT AND STATIONHOUSE RELEASE ARE GIVEN. FEDERAL ACTS DEALING WITH BAIL ARE DESCRIBED.
