Abstract
THIS ARTICLE ANALYZES RULINGS OF STATE SUPREME COURTS (KANSAS, NEW JERSEY, CALIFORNIA, AND PARTICULARLY ILLINOIS) ON THIS ISSUE IN LIGHT OF THE 1972 SUPREME COURT DECISION IN FURMAN V. GEORGIA, WHICH INVALIDATED THE DEATH PENALTY AS THEN APPLIED.
