A 1977 STUDY OF MAJOR NATIONAL EFFORTS DURING THE PAST 15 YEARS TO REDUCE THE IMPACT OF FINANCIAL RESOURCES, OR THE LACK THEREOF, ON THE DETERMINATION OF WHETHER A CRIMINAL OBTAINS FREEDOM PRIOR TO TRIAL.
Abstract
TRACED ARE THE RESULTS OF A NATIONAL STUDY ON BAIL REFORM SINCE ITS INCEPTION WITH THE MANHATTAN BAIL PROJECT OF 1961. A SURVEY OF THE MAJOR OPERATIONAL CHANGES IN THE BAIL SYSTEM SINCE THEN ALSO IS PRESENTED. DISCUSSED ARE SUCH PRETRIAL RELEASE MECHANISMS AS POLICE CITATIONS, SUPERVISED RELEASE, CONDITIONAL RELEASE ON OWN RECOGNIZANCE, AND BAIL DEPOSIT. IT IS THE AUTHOR'S CONCLUSION THAT THE FUTURE TREND OF BAIL REFORM SHOULD BE TOWARD THE DEVELOPMENT OF A COMPREHENSIVE PLAN THAT INTEGRATES THE VARIOUS EXISTING PRETRIAL RELEASE OPTIONS.
