BRIEF SUBMITTED BY THE MUNICIPAL JUDGE OF RICHLAND, WASHINGTON, CONCERNING THE RIGHTS VERSUS THE DUTIES OF THE INDIVIDUAL CITIZEN.
Abstract
THIS BRIEF IS PRESENTED AS A GUIDELINE FOR THE TRIAL OF FOUR 'DEFENDANTS CHARGED WITH RESISTING OR HINDERING POLICE. BY PRELIMINARY MOTION, THE DEFENDANTS CHALLENGED THE CONSTITUTIONALITY OF THE ORDINANCE ON THE GROUNDS THAT IT WAS TOO VAGUE AND WAS AN INVASION OF THE DEFENDANTS' RIGHT OF PRIVACY. BRIEFS WERE SUBMITTED AND ARGUMENTS WERE HEARD ON THE CONSTITUTIONALITY QUESTION PRECEDING THE REGULAR TRIAL. THE DEFENDENTS WERE FOUND GUILTY. (AUTHOR ABSTRACT MODIFIED)
