RESEARCH REPORT ON STATUTORY LICENSING BARRIERS TO THE EMPLOYMENT OF THE EX-OFFENDER IN TEXAS, BASED ON A SURVEY OF 36 STATE COMMISSIONS AND 32 CITY LICENSING AUTHORITIES.
Abstract
CONSIDERED ARE THE NECESSITY OF RESTRICTING EX-OFFENDER EMPLOYMENT IN AREAS HAVING NOTHING TO DO WITH PREVIOUS CRIMINAL BEHAVIOR, THE AMBIGUITY OF 'MORAL TURPITUDE' STATUTES WHICH EXCLUDE EX-OFFENDERS FROM TAKING LICENSING EXAMINATIONS, AND THE LICENSING STATUTES' FAILURE TO TAKE INTO ACCOUNT EX-OFFENDER REHABILITATION. BASED ON THE CITY AND STATE SURVEYS IT WAS FOUND THAT OF 61 STATE-REGULATED AND NOMINALLY LUCRATIVE OCCUPATIONS, THE EX-OFFENDER MAY BE EXCLUDED FROM ALL BUT THREE. THE CITIES, WHICH REGULATE MORE 'ORDINARY' OCCUPATIONS EXCLUDE THE EX-OFFENDER FROM A MAXIMUM OF EIGHT (AND THIS IN ONLY ONE CITY). POSSIBLE WAYS OF IDENTIFYING AND MODIFYING EMPLOYMENT BARRIERS FOR THE EX-OFFENDER ARE ALSO DISCUSSED. APPENDED IS A LIST OF 61 OCCUPATIONS IN TEXAS WHICH REQUIRE A LICENSE, THE STATUTORY REFERENCE WHICH CONTAINS THE LANGUAGE, AND THE LANGUAGE WHICH EXCLUDES EX-OFFENDERS.
