A TEXTBOOK DEFINES CRIMINAL OFFENSES AND LEGAL ISSUES ACCORDING TO WEST GERMAN LAW.
Abstract
THE EXTENT OF DESCRIPTION FOR EACH OFFENSE DEPENDS ON THE RELATIVE SIGNIFICANCE OF THE OFFENSE IN THEORY AND PRACTICE, SO THAT THE STUDENT CAN BECOME FAMILIAR WITH PROBLEMS COMMONLY ENCOUNTERED. DEFINITIONS OF BEHAVIOR SUBJECT TO CRIMINAL PROSECUTION ARE DETERMINED BY THE PRINCIPLE OF PROTECTION OF RIGHTS THAT ARE ESSENTIAL TO SOCIETY. AREAS COVERED INCLUDE OFFENSES AGAINST THE MOST PERSONAL RIGHTS (AGAINST LIFE, UNBORN LIFE, PHYSICAL INTEGRITY, PERSONAL FREEDOM, AND PERSONAL PRIVACY) AND OFFENSES AGAINST PERSONAL PROPERTY. THE RATIONALE FOR THE OFFENSE CLASSIFICATION IS EXPLAINED; I.E., THE BREAKDOWN OF OFFENSES INTO THEFT, PERPETUATION OF AN ILLEGALLY CREATED PROPERTY SITUATION, OR ECONOMIC CRIMES. ALSO DISCUSSED ARE OFFENSES AGAINST SOCIETY AS A WHOLE, AGAINST INTANGIBLES SUCH AS PUBLIC PEACE, AGAINST THE SOCIOETHICAL BASIS OF SOCIETY (I.E., RELIGION, FAMILY, SEX, HUMAN SOLIDARITY), AND AGAINST SECURITY OF LEGAL AND CURRENCY TRANSACTIONS. OFFENSES DESCRIBED THAT PRESENT AN IMMEDIATE DANGER ARE ARSON, TRAFFIC VIOLATIONS, AND INTOXICATION. FINALLY, OFFENSES ARE OUTLINED ACCORDING TO THOSE WHICH ARE AGAINST THE EXISTENCE OF THE STATE, AGAINST THE POWER OF THE STATE, AGAINST IMPORTANT PUBLIC INTERESTS, AGAINST THE ADMINISTRATION OF JUSTICE, AND AGAINST PUBLIC OFFICIALS. A BRIEF GENERAL BIBLIOGRAPHY IS FURNISHED, AS ARE SEPARATE LITERATURE ON EACH OF THE OFFENSES AND LEGAL PROBLEMS AND EXERCISES FOR PRACTICING APPLICATION OF CONCEPTS. --IN GERMAN. (KMD)
