Prepared for use in New York's prosecutorial training course, this volume contains nine papers that address such areas as victim rights, trial preparation, accusatory instruments, grand juries, indictments, and rules of evidence.
Abstract
An overview of the prosecution function focuses on prosecutorial discretion, ethical responsibilities, and civil liability. Rights of victims that prosecutors are responsible to uphold are described. Another paper categorizes local accusatory instruments and details grounds for motions to dismiss such instruments. A discussion of the preliminary hearing addresses its purpose and conduct, defendant's right to a speedy hearing, and disposition of a felony complaint after a hearing or waiver. The form, content, and sufficiency of an indictment and the procedure and law governing a motion to dismiss an indictment are outlined. Also considered is self-incriminating evidence, with attention to obtaining it, determining its admissibility, and using it at trial. Other presentations discuss statutes governing discovery in criminal prosecutions in New York State and grand jury procedures. Footnotes.
