THE QUESTIONS OF INFORMED CONSENT AND ETHICAL SAFEGUARDS, AND THE IMPLICATIONS OF EMERGING LEGAL RULINGS IN MEDICAL EXPERIMENTATION AND BEHAVIOR MODIFICATION ON INMATES ARE DISCUSSED.
Abstract
THE BASIC ELEMENTS OF INFORMED CONSENT ARE GIVEN AS: A FAIR EXPLANATION OF THE PROCEDURES TO BE FOLLOWED AND THEIR PURPOSES, INCLUDING AN IDENTIFICATION OF THOSE THAT ARE EXPERIMENTAL; A DESCRIPTION OF ANY EXPECTED DISCOMFORTS AND RISKS; A DESCRIPTION OF THE BENEFITS; AND A DISCLOSURE OF APPROPRIATE ALTERNATIVE PROCEDURES. RECENT LEGAL DECISIONS REVEAL THAT MANY OF THE INDUCEMENTS OFFERED TO INMATES AS PART OF BEHAVIOR MODIFICATION OR TOKEN ECONOMY SCHEMES MUST BE PROVIDED TO THE INMATE WHETHER HE PARTICIPATES OR NOT, AS PART OF HIS CONSTITUTIONAL RIGHT AGAINST CRUEL AND UNUSUAL PUNISHMENT.
