THIS STUDY ILLUSTRATES THE DYNAMICS OF THE CRIMINAL JUSTICE SYSTEM BY FOLLOWING A HOMICIDE CASE FROM THE CALL FOR SERVICE TO THE POLICE THROUGH THE CONVICTION OF THE DEFENDANT IN A TRIAL BY JURY.
Abstract
THE CASE DESCRIBED IS REAL, ALTHOUGH ALL NAMES, PLACES, AND DATES HAVE BEEN CHANGED. THE READER IS GIVEN VISUAL FAMILIARITY WITH DOCUMENTS TYPICALLY ENCOUNTERED IN CRIMINAL CASES, AND AN ATTEMPT IS MADE TO PLACE THE READER IN THE SAME POSITION AS THE VARIOUS DECISIONMAKERS DISPERSED THROUGHOUT THE SYSTEM. EVERY DOCUMENT OF SIGNIFICANT LEGAL IMPORTANCE IS REPRODUCED; DOCUMENTS WERE GATHERED FROM THE PUBLIC FILES OF THE PEOPLE AND AGENCIES INVOLVED IN THIS STUDY, AS WELL AS FROM THE PRIVATE OR CONFIDENTIAL FILES OF THE PARTICIPANTS. THE ACTUAL STEPS DESCRIBED ARE: THE COMMITTED CRIME, THE PROSECUTION, CONTINUED INVESTIGATION. PROCEEDINGS TO DETERMINE THE ACCUSED'S SANITY, THE PREPARATION FOR THE PRELIMINARY EXAMINATION, THE PRELIMINARY EXAMINATION, PRELIMINARY PROCEEDINGS IN THE SUPERIOR COURT, PREPARATION FOR THE TRIAL, AND THE TRIAL. AN INDEX IS INCLUDED. FOR A RELATED VOLUME, 'DYNAMICS OF CRIMINAL CORRECTIONS - A CASE STUDY FROM CONVICTION THROUGH PAROLE,' SEE NCJ-44006. (AUTHOR ABSTRACT MODIFIED).
