ARGUES THAT BODDIE SHOULD BE EXPANDED TO GUARANTEE THE WAIVER OF COURT COSTS AND FILING FEES IN ALL CIVIL LITIGATION AND PROVIDE COUNSEL AND INVESTIGATIVE SERVICES TO INDIGENTS REGARDLESS OF THEIR CLAIMS.
Abstract
IT IS HELD THAT THE MAJORITY HOLDING IN BODDIE SHOULD HAVE AFFIRMED THE RIGHT OF INDIGENTS TO UNFETTERED ACCESS TO THE JUDICIAL SYSTEM. IT IS ALSO ARGUED THAT IN WILSON V. WILSON IN PENNSYLVANIA, THE PETITION FOR COUNSEL AND INVESTIGATIVE SERVICES IN A DIVORCE ACTION SHOULD HAVE BEEN GRANTED.
