EXAMINATION OF THE LEGAL RIGHTS OF PRISONERS IN CANADA AND THE UNITED STATES.
Abstract
THE THREE MAJOR AREAS DISCUSSED ARE PAROLE, PRISON DISCIPLINE, AND PRISONERS' GRIEVANCES. THE INMATES' RIGHT TO DUE PROCESS IN PAROLE REVOCATION AND PAROLE GRANTING DECISIONS IN THE UNITED STATES AND CANADA ARE COMPARED. THE DIFFERING ASSESSMENTS OF THE ACCOUNTABILITY AND REVIEWABILITY OF PAROLE BOARD DECISIONS ARE ALSO GIVEN. DIFFERENCES IN PRISONERS' CIVIL RIGHTS AND PROCEDURAL GUARANTEES IN MATTERS OF PRISON DISCIPLINE IN THE TWO COUNTRIES ARE POINTED OUT. THE SUBJECT OF JUDICIAL REVIEW IN PRISON DISCIPLINARY PROCEEDINGS IS ANALYZED IN THIS CONTEXT. THERE IS A DISCUSSION OF WAYS IN WHICH INMATES CAN SECURE REDRESS OF GRIEVANCES IN THE TWO COUNTRIES. THREE OPTIONS ARE EXAMINED - PRISONERS' RIGHTS LAWYERS, THE OMBUDSMAN, AND INTERNAL GRIEVANCE COMMITTEES. A LIST OF REFERENCES IS PROVIDED. --SUMMARY IN FRENCH
