This handbook provides information on criminal law and procedure for security officers in California.
Abstract
Statutes governing detention and arrest procedures are reviewed, and the right to and requirements for conducting searches are examined. Miranda requirements are delineated, and a sample admonition to be used in obtaining statements or admissions is provided. Prohibitions against the use of threats, promises, force, or coercion in obtaining a statement also are considered. Types of evidence are described, including evidence from witnesses; and witness privileges (e.g., attorney-client, marriage) are enumerated. Pretrial proceedings are examined including custody and release, filing a complaint, arraignment, and discovery. Trial procedures are discussed with respect to appearance in court, jury questioning, opening and closing statements, jury instructions, and verdict. Preparation for and demeanor during testimony also are discussed. Types of daily reports and reports of noncriminal activity are described; and the reasons for and information sources and content of criminal activity reports are presented. Also covered are the elements of crime, its causes and classes, and the various types of crimes against persons and property. Codes of ethics for private security management and employees and a glossary are included.
