A COMPREHENSIVE SET OF PROPOSED STATEWIDE COURT RULES RELATING TO COURT ADMINISTRATION, PRACTICE, AND PROCEDURE IN THE JUVENILE COURT, BASED ON THE EXISTING CALIFORNIA JUVENILE COURT LAW.
Abstract
THE JUVENILE COURT RULES PROJECT WAS UNDERTAKEN TO ENCOURAGE GREATER UNIFORMITY IN APPLYING THE JUVENILE COURT LAW AND TO PROVIDE GUIDANCE TO JUVENILE COURT JUDGES, REFEREES, ATTORNEYS, PROBATION OFFICERS, AND SOCIAL WORKERS. THE FRAMEWORK FOR THE PROPOSED RULES IS A CONTEXTUAL RESTATEMENT OF EXISTING STATUTORY PROVISIONS AS INTERPRETED BY CASE LAW. THE ADVISORY COMMITTEE HAS ALSO INCLUDED GUIDANCE IN AREAS HAVING LITTLE PROCEDURE GUIDANCE IN THE STATUTES. PROCEDURAL HIGHLIGHTS IN THE PROPOSED RULES INCLUDE PREHEARING DISCOVERY PROCEDURES, DEPENDENCY AND WARDSHIP PROCEDURES, PROCEDURES FOR IMMUNITY TO WITNESSES, ANNUAL REVIEW HEARINGS, PROCEDURES FOR INTERCOUNTY TRANSFERS, AND HANDLING OF JUVENILE PROCEEDINGS OF APPEAL.
