THIS PAPER CONSIDERS THE EMERGING RIGHTS OF INSTITUTIONALIZED JUVENILES: CASES INVOLVING THE RIGHT TO COUNSEL, RIGHT TO CHALLENGE LEGALITY OF CONFINEMENT, RIGHT TO TREATMENT AND THE RIGHT TO FREE CHOICE.
Abstract
EMPHASIS IS PLACED ON THE LANGUAGE AND REASONING OF THE COURTS IN HOLDING FUNDAMENTAL RIGHTS APPLCABLE TO THOSE WHICH HAVE NOT REACHED THE AGE OF MAJORITY. THE FIRST PORTION OF THE PAPER REVIEWS WHAT THE COURTS HAVE SAID TO THE PAST ADJUDICATORY RIGHTS OF JUVENILES, FOCUSING ON THE RIGHT TO COUNSEL AND THE RIGHT TO CHALLENGE CONFINEMENT. IN THE SECOND PORTION OF THE PAPER, CASES REGARDING THE RIGHTS OF INCARCERATED JUVENILES TO TREATMENT ARE REVIEWED. THE THIRD PORTION OF THE PAPER, DISCUSSES THE RIGHT TO WORSHIP OR NOT TO WORSHIP, THE RIGHT TO EXPRESS PERSONAL PREFERENCES RELATING TO APPEARANCE, AND THE RIGHT TO BE FREE FROM CRUEL AND UNUSUAL PUNISHMENT....TWH
