The two sections of this volume devoted to cases and supplementary material on criminal procedure address the judicial process and limitations upon law enforcement practices and procedures.
Abstract
In its focus on the judicial process, the supplement covers several issues. These include prosecutorial discretion, the rights of indigents in formal criminal proceedings, the preliminary hearing, grand jury proceedings, the right to bail, pretrial motions, competency to stand trial, disclosure and discovery, pleas, trial by jury, quality of representation by counsel, problems encountered in presenting the case, submitting the case to the jury, sentencing alternatives, post-trial motions, and appellate and other post-trial remedies. Seven chapters review case and supplementary material related to confessions and interrogations; eyewitness identification procedures; the law of arrest, search, and seizure; wiretapping and electronic surveillance; exclusionary principles and alternative remedies for unlawful investigative practices; and the limits of undercover work.
