This casebook of criminal procedures has two parts, limitations on law enforcement practices and procedures and the judicial process.
Abstract
Cases in the first part specifically focus on confessions and interrogations; eyewitness identification procedures; the law of arrest, search, and seizure; and limits of undercover work. Cases in the second part deal with grand jury proceedings, pretrial motions, competency to stand trial, disclosure and discovery, pleas, trial by jury, problems encountered in presenting a case, submitting a case to the jury, sentencing, and appellate and other post-trial remedies. The cases address such criminal procedures as fifth amendment rights, unlawful arrests, investigative detention, due process, exculpatory evidence, double jeopardy and related principles, right to a speedy trial, plea bargaining, jury selection, witness cross-examination and impeachment, jury deliberations and verdicts, rules of evidence, and burden of proof.
