GOVERNMENT REGULATORY AGENCIES RELIEVE COURT CONGESTION BUT SUFFER FROM THEIR OWN PROBLEMS OF TOO MANY CASES AND INSUFFICIENT PERSONNEL.
Abstract
THE NATURE OF THE PROBLEM OF ADMINISTRATIVE DELAY IS DISCUSSED AND METHODS OF DEALING WITH IT ARE PRESENTED. EMPHASIS IS ON THE REDUCTION OF THE NUMBER OF CASES TO BE HANDLED AND INCREASING THE CAPACITY OF THE SYSTEM TO DECIDE CASES. THE AUTHOR MAKES SPECIFIC SUGGESTIONS WHICH INCLUDE PROCEDURAL INNOVATIONS TO ENCOURAGE SETTLEMENTS WITHOUT A FULL HEARING, LIMITING THE NUMBER OF HEARINGS, ARTICULATION OF AGENCY POLICIES AND STANDARDS, AND A REVIEW OF REGULATORY ENABLING ACTS.
