STATUTE WHICH REQUIRES A BACKGROUND INVESTIGATION BY POLICE AGENCIES FOR EACH MISDEMEANOR ARREST TO DETERMINE IF CITATION RELEASE BEFORE TRIAL SHOULD BE IMPLEMENTED.
Abstract
THE RATIONALE FOR USING THE CITATION PROCEDURE IS INVESTIGATED BY USING DATA FROM EXPERIMENTAL PROGRAMS IN CALIFORNIA AND NEW YORK CITY. THE BENEFITS IN COST AND TIME TO THE POLICE AND OTHER PUBLIC AGENCIES ARE OUTLINED. THERE IS A SUMMARY OF THE HARM TO THE DEFENDANT AND HIS RIGHTS THAT CAN BE CAUSED BY PRETRIAL DETENTION. DATA IS PROVIDED ON THE RISK OF FLIGHT IN CITATION RELEASES AND ON THE WIDE VARIETY OF OFFENSES FOR WHICH CITATIONS ARE REGULARLY ISSUED. THE CRITERIA FOR RELEASE DECISIONS UNDER CALIFORNIA'S NEW LAW ARE ANALYZED, AND IMPROVEMENTS ARE SUGGESTED.
