SITUATIONS FOR WHICH A PUBLIC ENTITY (MUNICIPAL GOVERNMENT) WILL OR WILL NOT PAY FOR DEFENSE SERVICES AND OR JUDGMENTS FOR POLICE OFFICER EMPLOYEES WHEN THEY ARE CHARGED IN CIVIL PROCEEDINGS ARE PRESENTED.
Abstract
CIRCUMSTANCES RELATING TO ON-DUTY OFFICERS, OFF-DUTY OFFICERS, OFF-DUTY OFFICERS IN SECURITY AND NON-SECURITY JOBS, OFF-DUTY OFFICERS IN POLICE ACTIONS BOTH WITHIN AND WITHOUT JURISDICTIONAL BOUNDARIES, AND OFF-DUTY PERSONAL INVOLVEMENT OF OFFICERS ARE ANALYZED. A DISCUSSION OF SITUATIONS IN WHICH DEFENSE AND NOT DAMAGES WOULD BE PROVIDED IS INCLUDED. THE AUTHOR SUGGESTS THAT ANY OFFICER IN AN OFF-DUTY SECURITY JOB (WHETHER EMPLOYED FOR SECURITY PURPOSES EXCLUSIVELY, OR WHETHER HIS EMPLOYER WOULD EXPECT HIM TO PERFORM IN THAT FUNCTION IF THE NEED AROSE) SHOULD CHECK WITH HIS EMPLOYER TO SEE IF HE IS COVERED, AND IF NOT, TO ENTER INTO A PRIVATE CONTRACT WITH HIS EMPLOYER.
