RULES, GUIDELINES, AND PREPARATION ACTIVITIES TO BE USED BY THE ADMINISTRATION OF THE CALIFORNIA YOUTH AUTHORITY ON ENTERING THE FIELD OF PUBLIC SECTOR COLLECTIVE BARGAINING ARE DEVELOPED IN THIS STUDY.
Abstract
A SEMI-COLLECTIVE BARGAINING LAW FOR PUBLIC EMPLOYEES BECAME EFFECTIVE JULY 1, 1978 IN CALIFORNIA, A STATE WHOSE ONLY PREVIOUS EXPERIENCE IN THIS AREA HAD BEEN AN EXPERIMENT IN THE PUBLIC SCHOOLS UNDER SENATE BILL 160. TO HELP THE CALIFORNIA YOUTH AUTHORITY, THIS STUDY REVIEWED THE LITERATURE, OBTAINED DATA FROM 24 SCHOOL DISTRICTS WHICH HAD PARTICIPATED IN THE SENATE BILL 160 EXPERIMENT, AND OBTAINED ANSWERS TO QUESTIONNAIRES FROM 48 STATE CORRECTIONAL AGENCIES, INCLUDING THE DISTRICT OF COLUMBIA. THE DIFFERENCES BETWEEN PUBLIC AND PRIVATE SECTOR BARGAINING WERE CONSIDERED AND THE POLITICAL PRESSURES SURROUNDING PUBLIC EMPLOYEE NEGOTIATION SESSIONS WERE EXAMINED. THE AGENCY IS URGED TO PREPARE FOR COLLECTIVE BARGAINING; 24 PREPARATION STEPS AND 38 GUIDELINES COVERING ALL PHASES OF THE COLLECTIVE BARGAINING PROCESS ARE PRESENTED AND DISCUSSED. SAMPLE PREPARATION ACTIVITIES ARE AS FOLLOWS: (1) THE ADMINISTRATORS OF THE AUTHORITY, OR ANY OTHER CORRECTIONAL AGENCY, SHOULD FAMILIARIZE THEMSELVES WITH THE GENERAL INFORMATION AND SPECIFIC DATA ON METHODS, TECHNIQUES, AND THEORIES OF COLLECTIVE BARGAINING VIA TRAINING WORKSHOPS, SEMINARS, SIMULATIONS, AND VISITATIONS AND (2) ADMINISTRATIVE-MANAGEMENT-SUPERVISORY STAFF SHOULD BE TRAINED THROUGHLY IN COMMUNICATIONS, HUMAN RELATIONS, CLEAR AND CONCISE WRITING, AND GOOD SUPERVISORY AND MANAGEMENT TECHNIQUES AND SKILLS. IT IS RECOMMENDED THAT ADMINISTRATORS HIRE EXPERTS IN LABOR RELATIONS AND COLLECTIVE BARGAINING AS ADVISORS AND CHIEF OF THE SURVEY INSTRUMENTS, A GLOSSARY OF COLLECTIVE MANAGEMENT. THE SECTION OF THE NATIONAL LABOR RELATIONS CODE DEALING WITH MANAGEMENT RIGHTS, COPIES OF THE SURVEY INSTRUMENTS, A GLOSSARY OR COLLECTIVE BARGAINING TERMS, AND AN EXTENSIVE BIBLIOGRAPHY ARE APPENDED.
