THIS TWO-VOLUME REPORT PRESENTS COMPARISONS BETWEEN OHIO LAW AND PRACTICE AS OF JULY 1, 1975, AND THE AMERICAN BAR ASSOCIATION (ABA) AND NATIONAL ADVISORY COMMISSION (NAC) STANDARDS OF CRIMINAL JUSTICE.
Abstract
EACH OF THE REPORT'S 19 SECTIONS COVERS 1 ASPECT OF THE CRIMINAL JUSTICE SYSTEM (PRETRIAL RELEASE, PROVIDING DEFENSE SERVICES, PLEAS OF GUILTY, APPELLATE REVIEW OF SENTENCES, ETC.). EACH SECTION IS SUBDIVIDED. PRETRIAL RELEASE, FOR EXAMPLE, INCLUDES GENERAL PRINCIPLES, RELEASE BY A LAW ENFORCEMENT OFFICER ACTING WITHOUT AN ARREST WARRANT, RELEASE BY A JUDICIAL OFFICER AT THE FIRST APPEARANCE OR ARRAIGNMENT, AND THE RELEASE DECISION. FOR EACH TOPIC, THE ABA STANDARD, NAC STANDARD, AND OHIO LAW OR PRACTICE ARE DESCRIBED, AND THE AUTHORS COMMENT AND RECOMMEND REMEDIES FOR DISCREPANCIES FOUND. THE FINDINGS DEMONSTRATE THAT THERE ARE NUMEROUS INCONSISTENCIES BETWEEN OHIO'S STANDARDS AND THOSE OF THE ABA AND NAC.
