PAPERS COMPARING CONCEPTS AND METHODS OF FRENCH CRIMINAL JURISPRUDENCE WITH CONCEPTS AND METHODS OF CRIMINOLOGY AND THE SOCIAL SCIENCES TO SHOW THE NEED TO INTEGRATE SOCIAL SCIENCE FINDINGS WITH THE CRIMINAL LAW SYSTEM.
Abstract
THE CONTRIBUTORS TO THE CONFERENCE POINT OUT THAT THE LOGIC AND METHODS OF CRIMINAL JURISPRUDENCE ARE TOO NARROW BY THEMSELVES TO TAKE FULL ACCOUNT OF ALL THE FACTORS IN A CASE AND TO ENSURE THAT JUSTICE IS DONE. THE TOPICS ANALYZED INCLUDE THE DEFINITION OF THE ELEMENTS OF A CASE, CAUSAL EVENTS LEADING UP TO AN OFFENSE, MORAL FACTORS IN AN OFFENSE, THE CONCEPT OF CRIMINAL RESPONSIBILITY, AND THE RATIONALIZATION OF PENAL SANCTIONS. THE PAPERS PROVIDE AN INSIGHT INTO THE RELATIONSHIP BETWEEN THE LAW AND SOCIAL SCIENCES IN THE FRENCH SYSTEM. --- IN FRENCH
