Within the juvenile and adult criminal justice systems of the United States there are offenders who, while considered competent to stand trial, are diagnosed as mentally retarded.

The literature pointed out numerous problems and injustices faced by the mentally retarded caught in the criminal justice system. Numerous professionals concerned with the problem of mental retardation and the criminal justice system have echoed the feeling that any perspective on the solution to the overall problem must address itself to the matter of presentation.
