This is a 1997 State-by-State overview of State law pertinent to the privacy and security of criminal justice information.
Abstract
For each State, the annotated texts of the laws themselves are provided along with any regulations and procedures mandated for the execution of the codes. Among topics addressed in some of the legislation are regulations; the collection and security of intelligence information; annual reports; collection and storage; access and use; security, updating, and purging; interstate systems for the exchange of criminal justice information; and civil and criminal remedies. Among the goals of the legislation are the protection of crime victims, the proper administration of justice, and the prevention of vigilantism. Some of the legislation includes provisions regarding the accessibility to employers or human resource agencies of the conviction records for persons who have committed sex crimes, drug crimes, or crimes of violence. Other legislative provisions pertain to standards for the maintenance of records; administrative, technical, and physical safeguards for records; the designation of employees responsible for agency compliance; and the expungement of criminal records. Various conditions under which criminal justice records information can be released, as well as procedures for the release of the information, are also contained in many relevant State laws.
