This article provides guidelines for California prosecutors in trying a gang-related homicide case.
Abstract
The problems inherent in gang homicide cases require specialized training of prosecutors in gang processes and in the development of investigatory and trial techniques that maximize case results. This article presents the basics of the training program for prosecutors at the Los Angeles Sheriff's Department's 5-day gang school. Guidelines for the obtaining of a search warrant rely on the expertise of experienced gang officers to develop the rationale and parameters of the search warrant request. In selecting jurors for a gang homicide trial, the guidelines identify signs of likely juror bias that would favor gang members, such as ignorance of gang characteristics and practices, hostility toward the police, and residence in a neighborhood with gangs. Guidelines for the use of expert witnesses focuses on their use to establish the defendant's gang membership. Other guidelines pertain to bail, witness protection, courtroom intimidation by gang members, bail for recalcitrant witnesses, dealing with informants, proving the gang's guilt, and the closing argument.
