These conference papers consider the development and impact of the Model Penal Code since its adoption by the American Law Institute in 1962, and reflect on the future of the codification movement in the U.S., Canada, and Europe.
Abstract
The first two papers discuss the historical antecedents of the Model Penal Code and the role of professional academics in the acceptance of the code. The subsequent papers focus on several specific aspects of the Model Penal Code, including culpability provisions and corporate liability. Several commentators offered critiques of the Model Penal Code in terms of moral theory and issues of deterrence and rehabilitation. The conference addressed the role of resulting harm under the code and in common law, and the code's approach to murder. One segment of the conference dealt with sentencing trends in relation to the Model Penal Code. Finally, the future of the substantive criminal law codification movement was examined in terms of theoretical and practical concerns. Chapter references
