CONGESTION AND DELAY IN THE CRIMINAL COURTS IS THE FOCUS OF THIS CANADIAN BIBLIOGRAPHY CITING WORKS ON SUCH SUBJECTS AS PRELIMINARY HEARINGS, JURY SELECTION, AND DISCOVERY AS FACTORS IN COURT CONGESTION.
Abstract
ORIGINALLY COMPILED TO PROVIDE GENERAL DOCUMENTATION FOR THE COURT DELAY RESEARCH PROJECT, AT THE UNIVERSITY OF TORONTO CENTRE OF CRIMINOLOGY, THIS BIBLIOGRAPHY WAS PUBLISHED IN ADVANCE OF THE PROJECT REPORT TO GIVE RESEARCHERS AND OTHER INTERESTED PERSONS ACCESS TO A REASONABLY CURRENT BIBLIOGRAPHIC REFERENCE TOOL. THE FIRST SECTION OF THE BIBLIOGRAPHY INCLUDES GENERAL REFERENCES ON PROBLEMS OF DELAY, FOLLOWED BY SECTIONS ON SPECIFIC FACTORS WHICH CAN CONTRIBUTE TO OR RELIEVE COURT CONGESTION. ADDITIONAL SECTIONS DISCUSS PLEA BARGAINING AND DIVERSION, DECRIMINALIZATION, AND OTHER ALTERNATIVES TO PROSECUTION. THE ORGANIZATION AND ADMINISTRATION OF COURT WORKLOAD AND RESOURCES IS INCLUDED IN LITERATURE ON CASELOAD MANAGEMENT (REMANDS, SCHEDULING, ETC.), COURT MANAGEMENT (PERSONNEL, ETC.), INFORMATION SYSTEMS, AND TECHNOLOGY. MOST OF THE LITERATURE IS CANADIAN, AMERICAN, AND BRITISH, AND HAS BEEN PUBLISHED SINCE 1970, ALTHOUGH SOME IMPORTANT EARLIER WORKS ARE INCLUDED. OVERALL, THIS BIBLIOGRAPHY EMPHASIZES SCHOLARLY AND ANALYTICAL ITEMS RATHER THAN DESCRIPTIVE ONES, AND SHOULD INTEREST MANY CRIMINAL JUSTICE PRACTITIONERS INCLUDING POLICE, LAWYERS, THE JUDICIARY, COURT PERSONNEL, LIBRARIANS, RESEARCHERS, AND STUDENTS.
