Abstract
THE INSTITUTE, HELD FOR THE SECOND AND SEVENTH CIRCUITS, U.S. DISTRICT COURTS, IN MORGANTOWN, WEST VIRGINIA, DESCRIBED THE RELATIONSHIP BETWEEN THE FORMAL SENTENCE IMPOSED BY THE JUDGE AND THE SUBSEQUENT TREATMENT OF THE OFFENDER BY THE PAROLE COMMISSION, THE BUREAU OF PRISONS, AND THE PROBATION OFFICE. WHILE STATUTORY AND CASE LAW DETAIL A NUMBER OF DIFFERENCES AMONG ALTERNATIVE SENTENCES, THE POLICIES AND PRACTICES OF AGENCIES CHARGED WITH POSTSENTENCING RESPONSIBILITY IS NOT USUALLY FOUND IN THE STANDARD LEGAL LITERATURE THESE PAPERS ARE AN ATTEMPT TO FILL THAT VOID. THE FIRST DISCUSSES ADULT OFFENDERS WHO DO NOT HAVE NARCOTICS PROBLEMS. THE PAROLE POLICY OF EACH SENTENCE LENGTH IS GIVEN; THE OPTIONS EXERCISED BY PAROLE BOARDS ARE DISCUSSED; AND NEW FEDERAL PROBATION AND PAROLE POLICIES ARE EXAMINED. THE SECOND PAPER COVERS THE SENTENCING OF YOUNG OFFENDERS AND NARCOTICS ADDICTS. THIS INCLUDES A DETAILED DESCRIPTION OF THE PROCEDURE OF SENDING AN ADDICT FOR OBSERVATION AND STUDY. THE FINAL PAPER DISCUSSES CHANGES WHICH THE NEW FEDERAL CRIMINAL CODE, THE PROPOSED SENTENCING COMMISSION, AND THE PROPOSED APPELLATE REVIEW WILL HAVE ON THE SENTENCING PROCESS.
