REVIEW OF THE SUBSTANTIVE LAW OF CRIMINAL CONSPIRACY AS IT APPLIES TO THE BUSINESS ENTERPRISE, AS WELL AS SPECIFIC STATUTORY PROVISIONS WHICH MAKE PARTICULAR AGREEMENTS ILLEGAL.
Abstract
THE LARGEST PART OF THE DISCUSSION IS LIMITED TO CONSPIRACY PROSECUTIONS UNDER FEDERAL LAW. FIRST, THE NATURE OF WHITE COLLAR CRIME IS CONSIDERED, AND THE APPLICATION OF GENERAL CONSPIRACY PROVISIONS TO SUCH CRIMINAL ACTIVITY IS EXAMINED. FOLLOWING THIS GENERAL DISCUSSION, ATTENTION IS GIVEN TO THE ELEMENTS OF THE SPECIFIC CRIMES OF CONSPIRACY TO RESTRAIN TRADE AND TO MONOPOLIZE. FINALLY, CONSIDERATION IS GIVEN TO THE USE OF THE GENERAL CONSPIRACY LAW TO DEAL WITH SPECIFIC CHARGES OF CONSPIRACY TO VIOLATE FEDERAL SECURITIES LAWS AND THE INTERNAL REVENUE CODE. (AUTHOR ABSTRACT)
