Abstract
THE SUBJECT AREAS DISCUSSED INCLUDE THE ROLE OF CONGRESS, CONSTITUTIONAL LANGUAGE, PRE-CONSTITUTIONAL RELATIONS, AND CRIMINAL JURISDICTION OVER INDIANS AND INDIAN TERRITORY WITHIN THE ORIGINAL STATES, JURISDICTIONAL QUESTIONS INCLUDE THE JURISDICTION OF CRIMES COMMITTED IN UNITED STATES TERRITORY, AND JURISDICTION OF CRIMES COMMITTED BY OR AGAINST INDIANS WITHIN BOUNDARIES OF STATES ADMITTED TO THE UNION AFTER 1789. PROCEDURAL GUARANTEES ARE EXAMINED FOR INDIANS WHO ARE UNDER STATE JURISDICTION AND WHO ARE UNDER FEDERAL JURISDICTION. A BIBLIOGRAPHY IS PROVIDED.
